Terms and Conditions

Entry into the Competition is subject to the terms set out below and information on how to enter this Competition and other details contained in promotional advertisements also forms part of these Terms and Conditions. Entry into the Competition constitutes acceptance of these Terms and Conditions.

 

Competition Entry: 

1. To participate in the Competition, a Participant must be an Eligible Entrant who submits an Eligible Entry during the Competition Period.

2. To submit an Eligible Entry during the Competition Period, the Eligible Entrant must: 

(a) find the Barry the Barramundi character graphic (“Barry the Barramundi”) located within the recreational areas of Lake Awoonga;

(b) scan the QR code on Barry the Barramundi; and

(c) complete in full the details specified on the electronic Entry Form (“Eligible Entry Form”). 

3. Information on the Eligible Entry Form also forms part of these Terms and Conditions.

4. Each Eligible Entrant may only submit one (1) entry per calendar month during the Competition Period. 

5. The maximum the number of entries per Eligible Entrant is 5. Entries are not transferrable.

 

Competition Period:

6. The Competition will be held at Lake Awoonga during the Competition Period. The Competition will end upon expiration of the Competition Period.

 

Eligibility:

7. The Competition is only open to Eligible Entrants. 

8. The Organiser reserves the right, at any time, to verify the eligibility of any Participant (including a Participant’s identity, age and place of residence) and to disqualify any Participant who does not comply strictly with these Terms and Conditions or who tampers with the entry process.

9. If requested by the Organiser, a Participant must provide the Organiser with reasonable evidence of eligibility. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

The Prize Draws:

10. The Organiser will conduct five (5) Prize draws between July and October 2025 including:

(a) four (4) monthly prize draws; and

(b) one (1) major prize draw.

11. All Eligible Entries will entered into an electronic randomiser. The Prizes will be drawn by way of an electronic randomiser of Eligible Entries.

12.The Prizes are not transferable, refundable, or exchangeable and cannot be taken as cash.

13.There will be five (5) Prize Winners will each win one of the following Prizes:

(a) for monthly prize draws, a VISA Gift Card valued at $500.00; or

(b) for the major prize draw, a VISA Gift Card valued at $3000.00.

14.The total Prize pool is valued at $5000.00

15.The Prize Winners will be drawn:

(a) for monthly prize draws, by 12:00pm on the last Thursday of the each of the first four months of the Competition Period; and

(b) for the major prize draw, by 12.00pm on the last Thursday prior to the completion of the Competition Period.

16.If the Prize Winner is under 18 years of age, the parent or guardian who gave permission for the entry into the Competition will be deemed to be the Prize Winner for the purposes of the Competition.

17. Each of the Prizes are awarded subject to any terms and conditions of Visa which may apply to the supply and use of Visa Gift Cards. Eligible Entrants are responsible for reviewing, understanding and adhering to such terms and conditions.

18.The Organiser is not liable for any loss, damage or injury suffered (even if caused by negligence) as a result of any Prize Winner accepting and/or using a Prize, except for any liability which cannot be excluded by law. 


Winner Notification:

19. The Organiser will use reasonable efforts to notify the Prize Winners by telephone and email. The results will also be published on the Organiser’s Facebook page.

20. Prize Winners must acknowledge receipt of the Organiser’s email and claim their Prize by replying to the notification and provide a postal address they would like their Prize sent to, along with any other reasonable information required by the Organiser.

21. Prize Winners must respond and provide all requisite information to the Organiser by no later than 5.00pm AEST 3 Business Days after being notified that they have won a prize.


Unclaimed Prizes:

22. If, despite reasonable efforts, the Organiser is unable to locate or contact a Prize Winner, or the Prize Winner does not respond in accordance with clause 21, another Prize Winner for that prize will be drawn. Any subsequent winners will be notified in accordance with these Terms and Conditions.

23. The Organiser accepts no liability where it is unable to contact Prize Winners who have not provided correct or complete contact details. If a Participant’s contact details change during the Competition Period, it is the Participants’ responsibility to notify the Organiser. A request to modify any entry information should be directed to the Organiser, with any such requests only accepted at the discretion of the Organiser.

24. The Organiser will have no liability for any loss or damage as a result of a Participant’s failure to receive notification emails as a result of technical or telecommunications problems, security breaches or settings, and the operation of the Participant’s email account, including delivery of emails to spam or junk email inboxes.


Prize Delivery:

25. The Prizes will be distributed by mail after the close of the Competition to the postal address provided by each Prize Winner to the Organiser.


Prize Substitution:

26. In the event any part of the Prize becomes unavailable for any reason beyond the Organiser’s control, the Organiser may substitute the Prize (or any part thereof) with a Prize of similar value.

General Conditions:

27. To the greatest extent permitted by law, the Organiser excludes all warranties, representations or guarantees regarding the Competition and any Prizes, including any warranties which may have been made in the course of advertising or promoting the Competition.

28. By entering the Competition, a Participant releases and indemnifies the Organiser and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the Participant may have against the Organiser or that the Organiser may incur for any loss or damage (including without limitation loss of opportunity or loss of profits) which is or may be suffered or sustained whether direct, indirect, special or consequential, arising as a result of an Participant entering the Competition or winning or failing to win a Prize, or using or permitting any other person to use the Prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.

29. The Organiser accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Organiser for any reason. The Organiser is not liable for any consequences of user error including (without limitation) costs incurred.

30. If for any reason beyond the reasonable control of the Organiser this Competition is not capable of proceeding as planned on the dates and in the manner described in these Terms and Conditions (including but not limited to technical failures, vandalism, natural disasters, extreme weather events, public safety concerns, acts of God, civil unrest, a law, rule or regulation of any government or governmental agency, strike, war or act of terrorism), the Organiser may in its sole discretion take any action that may be available to it, including to cancel, terminate, modify or suspend the Competition.

31. Each Participant indemnifies and will keep indemnified the Organiser against all claims, losses, damages and costs suffered or incurred by the Organiser or any third parties arising out of the breach of these Terms and Conditions by the Participant.

32. Prize Winners may have rights under the Australian Consumer Law and other similar legislation which cannot be excluded,restricted or modified by the Organiser. These Terms and Conditions do not exclude, restrict or limit those statutory rights in any way.

33. The Competition and these Terms and Conditions will be governed by the law of Queensland. Participants accept the non-exclusive jurisdiction of courts and tribunals of Queensland in connection with any disputes concerning the Competition.

Privacy:

39. By entering the Competition, Participants are taken to have consent to the Organiser using their personal information provided in connection with this Competition for the purposes of conducting this Competition, publishing the Prize Winner’s details, and distributing the Prize.

40. The collection and disclosure of personal information provided in connection with this Competition will be handled in accordance with the Organiser’s Privacy Policy (available at: https://www.gawb.qld.gov.au/privacy-policy). The Organiser is bound by the Privacy Act 1988 (Cth) and the National Privacy Principles.

41. The Organiser may, but is not obliged to, publish the results of the Competition. By participating in the Competition, the Participant gives their consent for their name to be published if they are the recipient of a Prize. If the Organiser decides to publish the results of the Competition, then the Organiser may publish the results on the Organiser’s website.

42. The Competition may be promoted or advertised on social media. By entering the Competition, Participants agree that the Competition is in no way sponsored, endorsed or administered by, or associated with any social media platform.

43. Eligible Entrants may access, change or update the personal information they provide the Organiser by telephone at +61 7 4976 3000 during office hours.

44. If a Participant would prefer that the Organiser does not use or disclose the Participant’s personal information in the way outlined in these Terms and Conditions and/or retain their personal information for the purposes described herein, the Participant should contact the Organiser.

Definitions:

Competition” means the opportunity to go into the draw to attempt to win a Prize in accordance with these Terms and Conditions.

Competition Period” means the period from 12.00pm Tuesday 1 July 2025 to 12:00pm Thursday 30 October 2025.

Eligible Entrant” means an individual who:

(a) is a resident of Queensland;

(b) if under 18 years of age, has a parent or guardian’s permission to participate in the Competition;

(c) is not a Non-Eligible Person; and

(d) submits an Eligible Entry.

Non-Eligible Person” means the following:

(a) employees of the Organiser who are involved in development, organisation or running of the Competition;

(b) employees of any agencies or businesses involved with the Competition; and

(c) members of the Organiser’s board or executive leadership team.

Eligible Entry” means an entry of a Participant which complies with the requirements of clause 2.

Organiser” means the Gladstone Area Water Board.

Participant” means any person who participates in the Competition.

Prize” means a VISA Gift Card of the value determined by the Organiser for each draw and specified in clause 14.

Prize Winners” means the five (5) Eligible Entrants that are drawn as winners of a Prize.
